SPRINGFIELD – State Senator Laura Murphy has introduced legislation to strengthen victim and witness privacy from unauthorized videos while in the courtroom.
“The witnesses and victims who testify in court deserve extensive protections and should never be made to feel intimidated by being filmed without their knowledge,” said Murphy (D-Des Plaines). “This legislation protects the privacy and safety of those taking the stand, by making sure only media with advance approval can take video.”
To ensure survivors of domestic violence and other crime victims are not intimidated by unauthorized filming, Senate Bill 4038 would make it unlawful for any person to record a video or transmit live video of a victim or witness inside of a state courthouse without that person's consent or authorization from the presiding judge. This legislation would not override any court orders that would govern media access, and would not apply to police body cameras or security cameras.
“In this country, we believe everyone has the right to a safe and fair trial,” said Murphy. “I believe that this legislation fortifies that right in Illinois.”
Senate Bill 4038 passed the Senate Executive Committee on Wednesday.
